Key Provisions in SB1070 Struck Down

U.S. District Judge Susan Bolton struck down key provisions in Arizona's infamous SB 1070 law today and ruled that states cannot preempt federal law. According to The Washington Post:

"Bolton ruled that the injunction would apply to the portion of the state law that requires police to try to determine the immigration status of a person they arrest, stop or detain while enforcing other laws if they reasonably suspect the person is in the United States illegally

If we build a gigantic tall fence around our borders, we should remember that anything that will keep people out will also keep people in. I personally don't care to live behind an Iron Curtain. And even if we do this, we will still be faced with human migration. SB 1070 was a step in the "police state" direction that Bob Waldrop mentions here. It was good that the judge saw fit to impose the injunction. We'll have to wait for the law to be struck down for good, however, before we can once again breathe more easily. I heard that Arizona is going to appeal--no surprise there.

Hopefully this will bring attention to who should be doing something , The folks in DC . Looks like the Judge was right , Constitutionally . The elected reps in DC are afraid to touch this problem , and as long as they delay , the more of a problem it becomes for illegal and legal immigrints , their families and for those who live here as citizens already.

I was thinking of the parallel of the Israel situation also. I was (am) disappointed that AFR (american family radio) still supports the Arizona law. AFR doesn't believe in amnesty in any form either. THey have no concern for families, etc. They are only concerned that the immigrants don't get citizenship status so they can keep their status quo in the political elections. (most immigrants vote for democrats).

I believe the real reason no one in Washington will deal with immigration reform is because, IN ADDITION TO SECURING OUR BORDERS (just want to be clear that's part of the picture) and streamlining the immigration process, we are going to have to provide some sort of penalty and path to legality that does not involve deportation for most of those who are already here.

Everyone knows that, but no one wants to admit it, especially before the mid-term elections. Right now, everyone wants to appear tough to appeal to the most xenophobic among us and to avoid the charge of being "soft" on undocumented immigrants.

It's kind of like Israel and Palestine. Israelis know they are going to have to share Jerusalem, Palestinians know there will be no right of return, but no one has the courage to admit the reality and forge the peace from there.
